1. About Pigeon
Pigeon is a messaging service that lets adults send thoughtful notes using a variety of delivery methods — timed, distance-based, night-only, and more — as well as cast and discover bottle messages and discover eligible people who are currently using Pigeon through “Here now.” Bottle messages are not sent to a specific recipient; they are distributed to other users based on shared interests and activity. Message delivery times are estimates and may vary based on the delivery method chosen. "Pigeon," "we," "us," and "our" refer to the operator of Pigeon and the pigeonsocial.app service. "You" and "your" refer to the person accessing or using Pigeon.
2. Eligibility
You must be at least 18 years old to create an account or use Pigeon. By using Pigeon, you represent and warrant that you meet this requirement. If we learn that a user is under 18, we will terminate that account immediately and without notice.
You must also have the legal capacity to enter a binding contract in your jurisdiction. Pigeon is not available to persons who have previously had their account terminated for violating these Terms.
3. Account Registration
To use Pigeon, you must register with a valid email address and verify it. Alternatively, you may register and sign in using your Google account via Google Sign-In, in which case we receive your name and email address from Google. You agree to:
- Provide accurate and truthful information during registration and keep it current.
- Keep your credentials confidential and not share your account access with others.
- Create and maintain only one personal account.
- Notify us immediately at [email protected] if you suspect unauthorized access to your account.
You are responsible for all activity that occurs under your account. You can control whether your profile appears in Pigeon's discovery feature from within the app settings. Pigeon may send push notifications to your device about message delivery events; you can disable these at any time in your device settings. You can also control whether eligible users see you in “Here now” using “Show when I’m here” under Pigeon’s Privacy settings. Disabling this setting does not prevent you from using the rest of Pigeon or viewing other eligible profiles.
4. Acceptable Use
You may use Pigeon only for lawful purposes and in accordance with these Terms. You must not:
- Post, send, or share content that is illegal, harmful, threatening, abusive, harassing, defamatory, fraudulent, obscene, or otherwise objectionable.
- Post, send, or share any child sexual abuse material (CSAM) or any content that sexualizes, grooms, sextorts, or endangers a minor. This is a zero-tolerance violation and will result in immediate account termination and mandatory reporting to law enforcement and the National Center for Missing & Exploited Children (NCMEC).
- Impersonate another person, entity, or Pigeon itself.
- Send unsolicited bulk messages or spam.
- Use Pigeon to stalk, harass, threaten, or intimidate any person.
- Attempt to gain unauthorized access to Pigeon's systems, infrastructure, or another user's account.
- Use automated means to scrape, harvest, or extract data from Pigeon without our express written permission.
- Interfere with or disrupt the integrity or performance of Pigeon or any related infrastructure.
- Use Pigeon for unauthorized commercial solicitation, advertising, or multi-level marketing.
- Use bottle messages primarily to campaign for or against a political party, candidate, government, public official, political ideology, armed conflict, or geopolitical cause; distribute political propaganda; or provoke hostile political debate. This rule applies regardless of the viewpoint or country involved. Respectful discussion of personal experiences, culture, history, civics, and current events is allowed when it otherwise complies with these Terms.
- Post, send, or share content that promotes, glorifies, or incites hatred or discrimination against any person or group based on race, ethnicity, national origin, religion, gender, gender identity, sexual orientation, disability, or veteran status.
- Share sexual, intimate, or nude images of any person without that person's explicit consent (non-consensual intimate imagery).
- Post, send, or share content that promotes, glorifies, or recruits for terrorist organizations, violent extremist groups, or acts of mass violence.
- Share graphic depictions of real-world violence or gore.
- Publish or share another person's private personal information — such as home address, phone number, financial details, or workplace — without their consent with the intent to harm, intimidate, or harass (doxxing).
- Violate any applicable local, state, national, or international law.
We reserve the right to investigate suspected violations and to take appropriate action, including removing content, suspending or permanently terminating accounts, and cooperating with law enforcement.
5. User Content
"User Content" means any messages, images, text, and other material you submit through Pigeon. You retain ownership of your User Content. By submitting User Content, you grant Pigeon a limited, non-exclusive, worldwide, royalty-free license to store, transmit, display, and process that content solely as necessary to operate and provide the service to you and the recipients you choose.
That processing includes translation when you ask for it. If you tap to translate a message or bottle, the text of that message is sent to our translation provider (OpenAI) to be screened for safety and translated, and the translation is stored so you can read it again. Nothing is translated unless you request it. See our Privacy Policy for how this data is handled and when it is deleted.
You represent and warrant that your User Content:
- Does not infringe any third-party intellectual property, privacy, or other right.
- Does not violate any applicable law or these Terms.
- Is not misleading, defamatory, or likely to cause harm to any person.
We do not pre-screen User Content but reserve the right to remove any content that violates these Terms or that we determine, in our sole discretion, is harmful to users or the integrity of the service.
Once a message is delivered to a recipient it cannot be recalled by the sender. When you delete your account, messages already delivered to other users may remain as message records in their inboxes, but Pigeon removes the message content and attached pictures and shows that the message was deleted because the account was deleted.
7. Privacy
Our Privacy Policy explains how we collect, use, and protect your information. By using Pigeon, you acknowledge the data practices described in that policy. The Privacy Policy is incorporated into these Terms by reference. This includes the use of recent foreground activity to provide “Here now” when you have enabled online-presence visibility, which you may disable at any time in Pigeon’s Privacy settings.
8. Pigeon's Intellectual Property
Pigeon and all of its original content, features, and functionality — including the name, logo, design, software, and materials we create — are owned by Pigeon and protected by applicable intellectual property laws. These Terms do not grant you any right to use Pigeon's name, logo, or branding.
You may not copy, modify, distribute, sell, sublicense, or lease any part of the service or its software. You may not reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Pigeon application.
9. Third-Party Services
Pigeon integrates with third-party services to operate, including:
- Google / Firebase — Firebase Cloud Messaging for push notifications, Firebase Crashlytics for diagnostics, Google Analytics for Firebase for app usage and onboarding measurement, Google Play AgeSignals for age verification at registration, and Google Sign-In for optional authentication.
- Cloudflare — for profile photo storage and content delivery.
- OpenAI — translation of messages and bottles, performed only when you ask for a translation.
- Google AdMob — the optional rewarded ads you can choose to watch to earn an extra bottle or unlock translations, and the sponsored card shown in the Discover tab.
- Google Play Billing — processing Pigeon Premium subscriptions.
- AppsFlyer — measuring which advertising campaign or link an install came from, so we know where new people find Pigeon. This runs only if you turn analytics on, and it is off by default.
- Other infrastructure services, such as hosting.
Those third parties are governed by their own terms and privacy policies, which we encourage you to review. We are not responsible for the practices or content of third-party services.
10. Termination
We may suspend or terminate your account at any time, with or without notice, if we reasonably believe you have violated these Terms, if required by law or legal process, or for any legitimate operational reason. You may delete your account at any time from within the app. When you initiate account deletion, your account is scheduled for permanent deletion after a 7-day grace period. During this period your data remains intact and you may cancel the deletion by signing back in. After 7 days, your account and associated data are permanently and irreversibly deleted. If Pigeon removes an account for safety, moderation, legal, or administrative enforcement reasons, deletion or anonymization may happen immediately, without the 7-day grace period.
Upon termination, your right to access and use Pigeon ceases immediately. The following sections survive termination: 4 (Acceptable Use, with respect to content already submitted), 5 (User Content), 7 (Intellectual Property), 10 (Disclaimer of Warranties), 11 (Limitation of Liability), 12 (Indemnification), and 13 (Governing Law and Disputes).
11. Disclaimer of Warranties
Pigeon is provided "as is" and "as available" without warranties of any kind, express or implied. To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that Pigeon will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We make no warranty regarding the quality, accuracy, timeliness, or completeness of any content or information obtained through Pigeon. Your use of Pigeon is entirely at your own risk.
12. Limitation of Liability
To the fullest extent permitted by applicable law, in no event shall Pigeon, its affiliates, licensors, service providers, employees, agents, officers, or directors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, data, goodwill, use, or other intangible losses, arising out of or relating to your use of or inability to use Pigeon, even if we have been advised of the possibility of such damages.
In jurisdictions that do not allow the exclusion or limitation of incidental or consequential damages, our liability is limited to the maximum extent permitted by law. In all cases, our total cumulative liability to you for all claims arising out of or relating to these terms or your use of Pigeon will not exceed the greater of (a) the total amount you paid to Pigeon in the twelve months preceding the claim, or (b) fifty US dollars (USD $50).
Some jurisdictions do not allow certain liability exclusions. If you reside in such a jurisdiction, some of the above limitations may not apply to you.
13. Indemnification
You agree to defend, indemnify, and hold harmless Pigeon and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use or misuse of Pigeon; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any applicable law or any third-party right, including any intellectual property, privacy, or publicity right.
14. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict-of-law principles. Subject to the arbitration provisions below, any dispute that may be brought in court must be brought exclusively in the state or federal courts located in Florida, and you consent to the personal jurisdiction of those courts.
Informal resolution. Before initiating any formal dispute, you agree to contact us at [email protected] and give us a reasonable opportunity — at least 30 days — to resolve the issue informally.
Binding arbitration. If the dispute is not resolved informally, you and Pigeon agree to resolve it through binding individual arbitration under the rules of the American Arbitration Association (AAA), rather than in court. You waive any right to a jury trial and any right to participate in a class action or representative proceeding. This arbitration agreement does not prevent either party from seeking injunctive or other equitable relief in court to prevent imminent irreparable harm.
EU and UK consumers. If you are a consumer in the European Union or United Kingdom, nothing in these Terms limits your right to bring claims in the courts of your country of residence under mandatory local consumer protection law.
15. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date on this page and, where reasonably practicable, provide notice through the app or by email. Your continued use of Pigeon after updated Terms become effective constitutes your acceptance of those changes. If you do not agree to updated Terms, you must stop using Pigeon and delete your account.
16. Miscellaneous
Entire agreement. These Terms, together with the Privacy Policy and any additional terms presented for specific features, constitute the entire agreement between you and Pigeon regarding your use of the service and supersede all prior agreements.
Severability. If any provision of these Terms is held invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full force and effect.
No waiver. Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.
Assignment. You may not assign or transfer your rights or obligations under these Terms without our written consent. We may assign our rights and obligations to a successor entity in connection with a merger, acquisition, reorganization, or sale of all or substantially all of our assets.
